These Terms of Service ("Terms") govern your use of services provided by Mlm Auto & Truck ("Company," "we," "our," or "us"). By using our services, you agree to be bound by these Terms.

Services Provided

Mlm Auto & Truck provides the following services:

  • Truck body repair and collision restoration
  • Custom fabrication and welding services
  • Paint and refinishing services
  • Emergency mobile repair services
  • Parts installation and replacement
  • Related automotive body work services

Service Agreements

Estimates and Authorization

  • All estimates are provided free of charge and are valid for 30 days
  • Written authorization is required before beginning any work
  • Additional work discovered during repairs requires separate authorization
  • Emergency repairs may be performed with verbal authorization when necessary

Work Performance

  • All work will be performed in a professional manner using industry-standard practices
  • We reserve the right to refuse service for any reason
  • Completion times are estimates and may vary due to parts availability or unforeseen complications
  • Customer will be notified of any significant delays

Payment Terms

Payment Methods

We accept the following payment methods:

  • Cash
  • Personal and business checks
  • Major credit cards (Visa, MasterCard, American Express)
  • Fleet accounts (with approved credit application)

Payment Terms

  • Payment is due upon completion of services unless other arrangements are made
  • Fleet accounts: Net 30 days from invoice date
  • Emergency services: Payment due at time of service
  • Large projects: Payment schedule may be arranged in advance
  • Late payments may be subject to a 1.5% monthly service charge

Warranties

Workmanship Warranty

  • 12-month warranty on workmanship for most repair services
  • 6-month warranty on paint and refinishing work
  • Custom fabrication warranty terms vary by project scope
  • Emergency repairs carry 90-day workmanship warranty

Parts Warranty

  • Parts are covered by manufacturer warranty
  • We will assist with warranty claims and replacements
  • Warranty does not cover normal wear and tear
  • Customer abuse or misuse voids warranty coverage

Warranty Limitations

  • Warranty covers repair or replacement of defective work only
  • Does not cover consequential damages or lost profits
  • Customer must provide reasonable access for warranty repairs
  • Warranty is void if work is modified by others

Customer Responsibilities

  • Provide accurate information about vehicle and repair needs
  • Remove personal items from vehicle before service
  • Provide clear access to work areas
  • Make payment according to agreed terms
  • Pick up completed vehicle within 5 days of notification
  • Report warranty issues promptly

Liability and Insurance

Our Liability

  • We maintain comprehensive general liability insurance
  • Garage keeper's liability covers vehicles in our care
  • Our liability is limited to the cost of services provided
  • We are not liable for pre-existing conditions or hidden damage

Customer Insurance

  • Customer is responsible for maintaining adequate insurance coverage
  • We will work with insurance companies on covered claims
  • Customer is responsible for deductibles and non-covered items
  • Insurance claim disputes are between customer and insurance company

Vehicle Storage

  • Vehicles left beyond 30 days after completion may be subject to storage fees
  • Storage fee: $25 per day after 30-day grace period
  • We reserve the right to move vehicles as necessary for operations
  • Abandoned vehicles may be disposed of according to state law
  • Customer is responsible for maintaining current registration and insurance

Dispute Resolution

Resolution Process

  • Disputes should first be addressed directly with management
  • Written complaints will receive written responses within 10 business days
  • We will make reasonable efforts to resolve disputes amicably
  • Unresolved disputes may be subject to mediation or arbitration

Governing Law

These Terms are governed by the laws of the State of North Dakota. Any legal proceedings will be conducted in the appropriate courts of Grand Forks County, North Dakota.

Emergency Services

  • Emergency services are available 24/7 at premium rates
  • Emergency rates apply to after-hours, weekend, and holiday service
  • Minimum charges may apply for emergency calls
  • Travel time and mileage charges apply to mobile services
  • Emergency authorization may be obtained verbally when necessary

Limitation of Liability

Our total liability for any claim related to our services is limited to the amount paid for those services. We are not liable for:

  • Consequential, incidental, or punitive damages
  • Lost profits or business interruption
  • Damage to cargo or contents not related to our work
  • Pre-existing conditions or hidden damage
  • Normal wear and tear or maintenance items

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
